We have an update regarding our page – we have to be prepared to get surprising letters from the Wikimedia Foundation. The link to a talk on a page belonging to the Wikimedia Foundation that we recently received a hint at, is here. We were initially not sure how fast we’ll manage to have the full backup online, just in case, but the backup was fortunately up the very same day we were notified about this talk. You will find our backup page here. Click and bookmark that link if you want to stay tuned – just in case.

To be honest – we find it absolutely interesting that the Wikimedia Foundation seems to have enough donation money to spend on lawyers fighting against non-commercial wordpress pages, but in case you are a visitor who found us via a link on a page belonging to this Foundation: “Trademark infringement occurs when the use of a trademark in connection with the sale of goods or services is likely to result in consumer confusion as to the source, affiliation, sponsorship or approval of those goods or services. However, if a party uses another’s trademark in a way that does not deceive the public, there can be no trademark infringement because a trademark owner has the right to prohibit only uses of its mark that are likely to result in consumer confusion.” (source) – Now it could be interesting to hear how on earth the personnel discussing here got the idea that our page or any content on it could be confused with their registered trademark. This is a wordpress page. Our contents are of mainly journalistic nature. With the exception of some press review pages, these contents are on basis of original research on the ground, meaning on basis of contributors who attend events themselves in order to report about them. Aside of those, our pages contain occasionally feuilleton style articles plus some literary work, marked as such. Both – work on basis of our own original research as well as literary contents are absolutely contrary to the nature of contents on pages related with the Wikimedia Foundation, where original research is not acceptable (quotes and linking to the quoted source are needed for verification), not to mention literary contents. The sentence  “in connection with the sale of goods or services” is especially interesting since we are not selling goods or services on this page.

Looking forward to the communication exchange.

Update: we read on the discussion page that what the Wikimedia Foundation might be missing is a disclaimer. No problem at all. Here is the disclaimer.

Update: “maximale Aufregung” – die sind gut.

  5. If you ever donated money to the Wikimedia Foundation, DO WATCH THEM NOW.

We have a link to another possible target of them – we have found it recently online. The twitter account on the right side is the owner of this – news outlet.

Do watch them, if you ever donated money to the Wikimedia Foundation – watch what they spend it for. If it’s for expensive legal fights about peanut topics, instead of doing something productive with the money, you should donate your kröten more careful.
