Justice Minister Merk. There Are Reasons to Doubt [Topic Gustl Mollath for English speaking readers]
Gustl Mollath is a German Whistleblower* who reported about cases of ‘black money‘ transfers from Germany to Switzerland. His own report to the authorities, a report that included names of involved bank accounts, was ignored by the Bavarian prosecution department (“Staatsanwaltschaft”). Instead, he was sentenced** to a life in the forensic psychiatry following personal charges filed by his wife.
The HypoVereinsbank made an internal investigation about the reported black money cases. The Bank confirmed in their audit report, signed 2003, that “all verifiable statements have proven to be correct” (“alle nachprüfbaren Behauptungen haben sich als zutreffend herausgestellt”). Some employees were dismissed then.
This audit report (“Sonderrevisionsbericht”) was requested by the Bavarian prosecution department in 2011. The Bavarian Minister of Justice, Beate Merk, stated in 2012, that “these are two different cases” (the files of the former wife and the charges regarding black money transfers filed by him) and that he is in the psychiatry for good reason****.
Note that the mentioned audit report contains a sentence saying that since Mr. Mollath lost his income*** and was, so the assumption of the audit, financially dependent on his wife, it “can not be excluded that he will bring the charges to the public“, in fact, and that there “is a risk that he eventually tries to sell his informations”.
This exact audit, signed 2003, is in the hands of the prosecution department since 2011. And Mrs. Merk gives an interview in 2012 saying that Mr. Mollath’s detention in the psychiatry is legit. Don’t miss this interview in its full length.
* There is a small side debate in Germany whether he can really be called a “Whistleblower”, lead by a few (2 or 3, but in written form only 1) typical erm Krautish small-checkered tie knotters, arguing that he was not involved himself but whistled as the husband of the involved employee (who would never have whistled, indeed said openly that she whill do care to destroy Mollath if he files a report about her or the Bank. This sentence was quoted by the person whom she said that to in a statuory declaration ["eidesstattliche Versicherung"]) [see 1] [and 2]. Taking into account that he is in the forensic psychiatry since the judgement/sentence 2006, called a confused and violent person, while his former wife is free and doing extremely dubious businesses in the meanwhile [re those dubious businesses after she had to leave the HypoVereinsbank following the audit, see the telepolis/heise.de-link here], gives however enough reasons not to doubt that Whistleblower label. Furthermore, he reported about trainings for HypoVereinsbank employees, in which he participated with his wife, trainings teaching the employees to incite bank customers to black money investments in Switzerland.
** He was not officially “sentenced” as such, he was declared not guilty but to be a person needing psychiatric help. He is in the Psychiatry until today.
*** After studying engineering, he started his own business in the sports automotive sector, a business that had to be given up
